· This exclusion does not apply to PIP and UIM.
· Spouses can be excluded in all companies, unless they are a registered/co-registered owner.
· We can exclude registered or co-registered owners, other than the spouse/co-insured.
· If there are two named insureds, both must sign the exclusion, even if the driver to be excluded is a named insured. If the second named insureds is unable to sign (i.e. does not reside, deployed, incarcerated, etc- then one named insureds signature is ok, however the other named insureds must have the "resides with insured" box unchecked.
· The exclusion may be used for operators other than the named insured.
· A new NDE is required for OR rated policies if there is any lapse of insurance.
The exclusion only may be used:
· because of the driving record of the person to be excluded.
· because the excluded person's license is suspended for any felony conviction with proof of a material element involving the operation of a motor vehicle. [ORS 809.410(4)].
· because the excluded person's license is suspended for incompetence to drive a motor vehicle because of a mental or physical condition [ORS 809.410(16)].
· because the liability rate for the driver to be excluded would cause a financial hardship to the insured. Financial hardship is caused when the annual difference in premium to insure or not insure the driver is more than $1,000. High performance and sport car surcharge cannot be considered in the $1,000 [OAR 836.058.0010].
Notes:
· For the financial hardship reason, premium increases must be based on the liability coverages (BI and PD).
· In all situations where driving record may be used as a reason, select only "driving record" as the reason on the NDE being sent. Example: Both driving record and suspensions would qualify the driver for an NDE, use only the driving record reason.
· If the form is returned with more than one reason selected, the form is valid as long as the driver met one of the required, selected conditions for exclusions.

Must be received prior to binding and only with Supervisor approval.
